Will an eviction show up on my record if I never signed a lease or any agreement? If you are actually evicted, then yes, itll show up. Court records are public. You dont need a signed lease agreement to be evicted. It helps, but isnt necessary. All that is required is that the person being evicted have tenant status. That means you have lived in the property with the owners knowledge and consent for at least 30 days. Once you have tenant status, the only way you can be removed from the property is through a legal eviction. To evict, the landlord must follow very specific legal procedures and timelines. You must get a cure or quit notice giving you a specific amount of time to remedy whatever is causing the eviction or vacate the premises. Then you get a notice of intent, which allows you the opportunity to protest the eviction. That means, for instance, if youre being evicted for non-payment of rent, you have the chance to show the Court your rent receipts proving that you did, in fact, pay your rent. Then the Court reviews all the paperwork, and barring any reason not to do so, the Court issues a Notice of Eviction, which includes a vacate by date. At this point, you are evicted. Its on your record. It will stay on your record for years. Many landlords will not rent to you once you have an eviction on your record.
