In the Indian law can I lease?
Legally you cannot rent out your mothers property through agreement to a third party even after demise of your mother, unless such property is mutated exclusively in your favour by way of mutation through succession provide that you are her sole legal heir. If the property is not transferred in your name (either by succession/ sale/ gift/ will etc.), you have no legal right to enter into a lease/ rent agreement.
